Commemorative Paver Application Agreement

As a fundraising effort for the construction of a permanent Firefighter Memorial, the Cuyahoga Falls Firefighter Memorial Foundation is seeking donations for Commemorative Pavers to be placed at the Memorial Site. 

To apply to sponsor a Commemorative Paver for the Cuyahoga Falls Firefighter Memorial, please read each of the terms and conditions listed and sign below. 

1.     The Cuyahoga Falls Firefighter Memorial Foundation (hereafter, “the Foundation”) reserves the right and in its sole discretion to deny application for sponsoring a commemorative paver and return or refund and fees to the applicable party or parties (hereafter, “the Donor”).  Further, the Foundation alone will determine the placement and location of individual paver locations. Pavers will be placed for optimal layout design at the time of installation and, therefore, a specific position cannot be chosen or guaranteed.

2.     No logos or advertising is permitted on pavers.

3.     The Foundation agrees to maintain commemorative pavers for a period of twenty (20) years following the date of the dedication of the Memorial.  After this time period, any alterations to the Memorial site may or may not include commemorative pavers.  If the paver is permanently removed prior to this twenty-year date, the Foundation agrees to refund the Donor a prorated portion of the original fee in the amount of $10 per year for each year less than twenty years that the paver was installed.

4.     Donor understands that pavers may chip, crack, wear, or otherwise become damaged due to any cause, and further understands that the Foundation will take reasonable steps to repair pavers where possible.  Where widespread repairs are required, the Foundation may elect to forego repairs and remove commemorative pavers.

5.     Donors agree that purchase of a commemorative paver will not result in recognition on the “Donor Wall” at the Memorial site, which is reserved for separate sponsorship agreements and donations.  Additionally, the application fee for the commemorative paver will not count towards total donation contributions as required for recognition on the Donor Wall.

6.     The Foundation may elect to photograph or film the pavers with name(s) contained in the inscription for promotional events, or any other manner whatsoever that complies with the mission statement of the Foundation without the consent of or payment or compensation to the Donor or the individuals named on the paver.

7.     Donor’s only right or remedy as a result of any breach of the Foundation’s obligations under this agreement shall be to receive a refund of the sponsorship fee.

8.     Donor agrees to proofread all wording, spelling and spacing on the donor application and accepts all responsibility for any misspellings or inaccuracies that result.  If an error is discovered after installation and was the fault of the Donor, the Donor will pay any additional costs to correct the error.  If the error was on the part of the Foundation or the engraver, the Foundation will absorb the additional costs and there will be no further charge to the Donor.

9.     The Cuyahoga Falls Firefighter Memorial Foundation is a 501c3-registered non-profit organization and all donations are tax-deductible as allowed by law.
